On or about June 15, 2012, the President of the United States, President Obama, issued Executive Action called DACA. DACA stands for “Deferred Action for Childhood Arrivals”. On November 20, 2014 President Obama issued another Executive Action that expanded DACA and also established Deferred Action for Parents of United States Citizens and permanent residents.

The idea was to prevent low priority individuals from being placed in removal proceedings or removed from the United States.

To qualify for DACA, you must:

  • Have been brought to the United States as a child;
  • Have been in the United States since January 1, 2014;
  • Have continuously lived in the United States since January 1, 2014;
  • Have entered the United States without a visa;
  • Have been in the United States without immigration permission;
  • Have not been convicted of a felony offense. A felony offense is a federal, state or local criminal offense punishable by imprisonment for a term of one year or more;
  • Have not been convicted of a significant misdemeanor offense or three or more misdemeanor offenses;
  • Not pose a threat to national security or public safety;
  • Pass a background check;
  • Have completed High School or currently in school.
